% 03.01.2018 Learned counsel for the petitioner states that pursuant to a settlement with the respondent, his client had received some post dated cheques for Rs.17,11,464/-. These were returned unpaid. He submits that however, his client has now received Rs.13,92,886/-. Hence, the balance should be paid by the respondent as per the settlement agreed upon. Learned counsel for the respondent on instructions undertakes to make the necessary payment as per the settlement cheque amount within two months from today.
In view of the above, learned counsel for the petitioner seeks to withdraw the petition.
Petition is dismissed as withdrawn.
In case there is any default on the part of the respondent, liberty is
