I note that this matter was adjourned sine die to await the judgment of the Division Bench on 3'' December, 2009. It is averred in the application that parties have settled their inter-se disputes before the Division Bench and have filed an application under Order XXIII Rule 3 CPC in that regard. The Division Bench has taken on record the settlement and disposed of the appeal in terms thereof.
