FAO(OS) (COMM) 39/2016 & CM 21047/2016 (stay) & CM 21048/2016 (u/S 151) We have heard the learned counsel for the parties. The learned counsel for the respondent states that they have an objection towards the maintainability, but in the facts of the present appeal, they are not pressing that.

By consent of the learned counsel for the parties, Professor V. Kamamkoti will be produced for cross-examination by the appellant, in the first instance, on 01.06.2016 at 10:30 am before the Local Commissioner. No other issue pertaining to the impugned order is being dealt with by us in the present appeal. The learned Single Judge, in any event, has noted that an appropriate order would be passed in relation to the other witnesses mentioned in the last paragraph of the impugned order dated 25.05.2016. Because the learned Single Judge is seized of the matter with regard to those witnesses, this appeal is not being pressed in respect of the said witnesses. The appeal stands disposed of.
