% 03.05.2016 The present petition has been filed under Section 482 Cr.P.C.for quashing of FIR No.235/2015 under Section 363 IPC registered at PS Nand Nagri, Delhi.

The petition came up for hearing on 07.04.2015 when notice was issued in the petition and it was directed that no coercive steps be taken against the petitioner and his wife. The matter was adjourned to 12.05.2015 when the matter was posted for 18.08.2015 on account of lawyers abstaining from work.

On 18.08.2015, none appeared for the petitioner and matter was dismissed for non prosecution.

The petitioner filed an application for restoration of the petition which was allowed vide order dated 24.08.2015 and matter was restored to its original number and was adjourned to 22.12.2015. On 22.12.2015, it was stated that the petitioner and respondent No.3 are living together as husband and wife and respondent No.3 has given birth to a girl child on 20.12.2015. An adjournment was sought to ensure the presence of respondent No.3 as she was not present on that date and the matter was adjourned to 04.04.2016. On 04.04.2016, at the request of the learned counsel for the petitioner, the matter was adjourned for today.

Today, despite the matter being called out thrice since morning, there is no appearance on behalf of the petitioner. It appears that the petitioner is no more interested in prosecuting the matter.

Dismissed for non prosecution.
