% 20.03.2017 MAT.APP. 1/2013 CM No. 19753/2014 CM No. 8689/2015 CM No. 7029/2017 A demand draft of Rs. 14 lakhs which had been issued to the petitioner stands honoured. Petitioner/appellant is present in person. She seeks permission of this Court to withdraw the appeal in view of the permanent settlement having been arrived at between the parties pursuant to which this demand draft in the sum of Rs. 14 lakhs had been handed over to the petitioner (on the last date it had been typographically wrongly noted as 15 lakhs).

This court notes that the appellant had filed an appeal against the judgment of the learned District Judge dated 18.07.2012 wherein the

respondent / husband namely Bijender Kumar had been granted divorce under Section 13 (1) (a) of the Hindu Marriage Act. The petitioner / appellant wife had filed an appeal. In view of the afore noted settlement arrived at between the parties permission to the petitioner to withdraw her appeal against the judgement dated 18.07.2012 is granted. It has been agreed between the parties that FIR No. 224/2012 under sections 498/406 IPC at PS Defence Colony will be sought to be quashed by the respondent and in those proceedings the petitioner / appellant wife will fully cooperate with the respondent.

The sum of Rs. 10,000/- per month which was being deducted from the salary of the respondent in favour of the petitioner will now be stopped in view of the said settlement having been arrived at between the parties. A communication of this settlement also be sent to the Director, Dr. Rajender Prasad Eye Hospital, AIIMS.

Order be given dasti under signatures of Court Master to learned counsel for the respondent who may also intimate the Department. Appeal disposed of in the above terms.
