% 05.08.2016 CS(OS) 2879/2014 Case file has been taken up pursuant to order dated 25.07.2016 of learned Registrar (Original) on the basis of order dated 10.06.2016 of learned District and Sessions Judge (West), who has transferred back the matter to this court in view of notification no.5456/DHC/Orgl/2016 dated 28.04.2016.

As per instructions of learned Registrar General conveyed through learned Registrar (Original), only IPR related matters covered as per notification no.5456/DHC/Orgl/2016 dated 28.04.2016, are to be retained in this court. The present suit for recovery of Rs.24,84,419.98, is a non IPR matter and hence has to be transferred to the concerned District Court having pecuniary and territorial jurisdiction.

Learned counsel for plaintiff has submitted that since loan was taken by the defendants from Asaf Ali Road, New Delhi Branch, therefore the matter may be transferred to Central District, Tis Hazari Contd....2

-2Court, to which learned counsel for defendant no.1 has no objection. The ministerial order dated 11.01.2016 for transfer of the present matter to West District, Tis Hazari Court is modified. Accordingly, in view of notification no.27187/DHC/Orgl. Dated 24.11.2015, the present matter stands transferred. Parties are directed to appear before the Court of Ld. District Judge, (Central) (Headquarter), Tis Hazari Court Complex, Delhi on 06.09.2016 at 10.00 a.m.
