% 30.05.2016 Present writ petition has been filed seeking a direction to respondents No.1 & 2 to take appropriate action against respondent No.3-school for allegedly violating provisions of Delhi School Education Act, 1973.

A perusal of the paper book reveals that the petitioner made a representation dated 12th May, 2016 to respondent nos. 1 & 2 regarding various issues, but no reply has been received till date. Admittedly, the respondent no.3 is an unaided minority school. The counsel who appears on advance notice for respondent no.3 states that the present writ petition has been filed for an oblique purpose. Keeping in view the aforesaid, the present writ petition is disposed of with a direction to respondent no.2 to decide the

petitioner's representation dated 12th May, 2016 within a period of three months, after giving notice to the petitioner as well as to respondent no.3/School and its Principal and after keeping in mind the fact that the respondent no.2 being an unaided minority school is entitled to constitutional protection.

This Court, however, makes it clear that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open. MANMOHAN, J MAY 30, 2016 KA
