O R D E R

1. By an order dated 15th September 2016 in Arb. P. 346 of 2016, this Court has appointed Dr. Justice M.K. Sharma, a former Judge of Supreme Court of India as Arbitrator. A letter has been received from the learned Arbitrator declining to act as such.

2. In that view of the matter, the Court appoints Justice Vikramajit Sen, a former Judge of Supreme Court of India, (Mob. No.8447333366) as an Arbitrator on behalf of the Respondent. Both the Arbitrators i.e. the one appointed by the Petitioner as well as Justice Vikramajit Sen will mutually appoint a Presiding Arbitrator within one month to complete the constitution of the Arbitral Tribunal ('AT').

3. The AT shall ensure compliance of the provisions of the Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration. The fee of the Arbitrators shall be in terms of the schedule to the Act as amended with effect from 23rd October 2015.

4. If there is any difficulty in constitution of the AT, it will be open to the parties to apply to the Court.
