At the request made on behalf of the learned counsel for the appellant, the present case was adjourned on 04.1.2018 for today to enable him to obtain instructions.

Today, Mr. Saharya, learned counsel for the appellant states that the Department has not informed him as to whether anything survives for adjudication in the present appeal, after the Supreme Court has disposed of Civil Appeal No. 3021/2013, arising out of SLP No. 2110/2011 on 3.4.2011. 3.

In these circumstances, we have no option but to dispose of the present appeal. If the appellant/NDMC seeks revival of the present appeal, it shall file an appropriate application in this regard. 4.
