In view of this, the learned counsel for the applicant seeks permission to withdraw this appeal with liberty to move a fresh application under Order XXXIX Rules 1 & 2 CPC and to bring to the notice of the Court certain facts and circumstances, which did not exist and were not placed before the learned Single Judge at the time of the initial order of injunction dated 22.12.2010.
