O R D E R

% 26.05.2017 Learned counsel for both the parties state that the matter has been compromised in accordance with the Deed of Settlement, Agreement-cum-Undertaking dated 15th May, 2017. Both the counsel further assure and undertake to this Court that parties shall comply with the settlement terms mentioned in the aforesaid Deed of Settlement. They also assure this Court that all the goods which was seized vide order dated 03rd August, 2015 shall be destroyed within a period of two weeks.

The aforesaid statements, assurances and undertakings as well as the undertakings mentioned in the aforesaid Deed of Settlement are accepted by this Court and the parties are held bound by the same. This Court has also perused the Deed of Settlement, Agreement-cum-Undertaking dated 15th May, 2017 and is of the opinion that the compromise/settlement is lawful.

In view of the aforesaid, learned counsel for the plaintiffs wishes to withdraw the present suit. Consequently, the same is dismissed as withdrawn.
