versus STATE ( GOVT OF NCT OF DELHI) & ANR ..... Respondents Through:

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 22.11.2018 By this petition, petitioner has prayed for quashing of FIR No. 73/2014 under Sections 394/34 IPC, registered at police station Mandawali on the complaint of respondent no.2, on the ground that matter has been amicably settled between the petitioner and respondent no.2. I have perused the FIR. Complainant has specifically alleged in the FIR that on 25.01.2014 he was returning home and when he reached near Railway Bridge, South Ganesh Nagar at about 3:30 pm four boys surrounded him and snatched `2,500/- cash, mobile phone etc. from him. One of the boys also picked up a stone and hit on his head resulting injuries to him. A police constable and two public persons caught hold of one of the

assailants (petitioner). Petitioner was apprehended at the spot. Keeping in view the serious allegations of robbery, in my view, this is not a fit case to quash the FIR on the ground of settlement.

Petition is dismissed.

Miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J.
