After making certain submissions, learned counsel for the petitioner, on instructions, submits that the petitioner does not want to continue with the writ petition and the same may be dismissed as withdrawn. He submits that liberty may be granted to the petitioner to file an appeal before the High Court under Section 30 of the Employees' Compensation Act, 1923.

Learned counsel for respondent no. 1 has no objection. 3.

In the circumstances, the petition is dismissed as withdrawn with such liberty.

If the petitioner files an appeal under Section 30 of the Employees' Compensation Act, 1923, the amount so deposited with the Registry

of this Court in this Writ Petition may be treated as "pre-deposit" in the appeal.
