% 30.05.2016 Present writ petition has been filed challenging the decision of respondent no. 2-ERC taken in its meeting held between 24th and 25th April, 2016 whereby petitioner-Institute's application for D.El.Ed. course for Academic Session 2016-17 was refused on the ground that as per the Visiting Team report petitioner-Institute has built up area of 2323.00 sq. mtrs. which is less than the area required for B.Ed. (existing) and D.El.Ed. (proposed programmes).

Since an appeal is maintainable against the decision of respondent no. 2-ERC, this Court refuses to entertain the present writ petition. This Court is also of the view that serious disputed questions of fact arise in the present

petition which cannot be decided in writ proceedings. Consequently, present writ petition is dismissed with liberty to the petitioner to file an appeal against the impugned order in accordance with law.
