% 07.02.2019 CM APPL. 10290/2018 (withdrawal of Vakaltnama) 1.

This is an application filed by Mr.Harish Kumar Garg, Advocate seeking withdrawal of his Vakaltnama. 2.

As per the averments made in the application, the counsel has already given written intimation about withdrawal of the Vakaltnama to the petitioner on 20.01.2018.

Mr.Garg states that he has not been able to get instructions from the petitioner. The record also shows that despite being served pursuant to the orders of this Court, the petitioner has not entered appearance.

In these circumstances, the application seeking withdrawal of the Vakalatnama and discharge of Mr. Harish Kumar Garg, is allowed.

The application stands disposed of.

Vide order dated 08.10.2018, Court notice was issued to the petitioner. As per the office report, the petitioner has been duly served, but still none appears for the petitioner, despite passover. 2.

It appears that the petitioner is not interested in pursuing the matter and the same is dismissed in default and for non-prosecution. 3.

The record also shows that vide order dated 08.10.2012, the petitioner was directed to deposit 50% of the awarded amount, which amount was duly deposited by the petitioner. In view of the fact that the writ petition is being dismissed, the Registry is directed to forthwith release the deposited amount in favour of the respondent alongwith interest accrued thereon. It is made clear that, it will be open for the respondent to take steps to recover the balance awarded amount from the petitioner in accordance with law. REKHA PALLI, J FEBRUARY 07, 2019 sr
