Ms. Devyani Singh, Advocate for the plaintiff states that she has instructions from the plaintiff to withdraw the suit with liberty to press for the appropriate relief in arbitration proceedings. 3.

She also seeks refund of the court fees.

The suit is dismissed as withdrawn with liberty aforesaid. 5.

A certificate entitling the plaintiff to obtain refund of 50% of the court fees paid on the plaint be issued and handed over to the counsel for the plaintiff.

We are the defendants no.4 and 5 in this suit. 2.

We have for ourselves and on behalf of defendants no.1 to 3 compromised the disputes subject matter of this suit with the plaintiff on the terms as recorded in today‟s order sheet which has been dictated in our presence.

We undertake to this Court to do all that we have agreed to do and as recorded in para no.5 & 10 of today‟s order sheet and which has also been signed by us.

We have understood the consequence of breach of undertaking given to the Court.
