The present appeal concerns award dated 05.02.2012, objections to which were dismissed by learned Single Judge in order dated 17.08.2012 (OMP No. 737/2012) concerning Claim Nos. 1,2,3,8,9,11 and 12.

Mr. Khurana, learned counsel restricts the present appeal to issues concerning claim nos. 9,11 and 12 which are identical to issues 11,13 and 14 in FAO(OS) 9/2013.

In view of our decision in FAO(OS) 9/2013, the present appeal is dismissed without any order as to cost. Amounts deposited in Court by NHAI shall be released to respondent claimant and the bank guarantees

by the respondents shall be discharged.
