% 06.08.2018 Learned counsel for the petitioner submits that petitioner is owner of property bearing plot no. 7, Sainik Vihar, Pitampura, New Delhi. Petitioner had not sold the said property to co-accused Anoop Kumar Gupta as alleged by the prosecution. The documents regarding sale transaction were sent to FSL along with specimen signatures and finger/thumb impression of the petitioner. As per FSL report, the specimen signatures, finger/thumb impression of co-accused Anoop Kumar Gupta matched. It is further submitted that allegations against the petitioner are that he had mortgaged the aforementioned property with several banks in order to avail loans from different bank including the complainant. Investigations are complete and charge-sheet has been filed. Petitioner is in custody for about 5 years. Trial
is likely to take time. Hence, it is prayed that petitioner may be admitted to bail.
Learned APP has opposed the bail. It is contended that the aforesaid property was mortgaged by the petitioner with multiple banks in connivance with co-accused Anoop Kumar Gupta.
Apart from the present case, petitioner is also involved in three other cases. Learned counsel for the petitioner submits that petitioner had taken loan from the complainant bank only and not from the other banks. So far as involvement of petitioner in other three cases are concerned, petitioner is already on bail in those cases.
Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail subject to his furnishing a personal bond in the sum of ₹50,000/- with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
