O R D E R

% 21.09.2016 IA No. 11641/2016 (under Order XXIII Rule 3 CPC) & CS (OS) No. 920/2015

1. This is an application jointly filed by the parties stating that the disputes have been settled. The application is signed by the Plaintiff and the Defendant and supported by their respective affidavits.

2. The application is allowed.

3. The suit is decreed in terms or prayers 24 (i), (ii) and (iv) of the plaint.

4. In terms of Clause 3 (f) of the settlement, two representatives of the Plaintiff company will be permitted by the Defendant to inspect the Defendant's premises within a period of four weeks from today. CS (OS) No. 920 of 2015

5. Since the matter has been decreed by way of settlement prior to the framing of issues, the Plaintiff is entitled to refund of half of the amount of court fees under Section 16A of the Court Fees Act, 1870.

6. The Registry will now prepare, and issue to the Plaintiff, within two weeks from today, a certificate entitling the Plaintiff to receive back from the Collector of Stamps half of the amount of the court fees paid by the Plaintiff on the plaint.
