% 20.04.2017 By the present petition, the petitioner seeks quashing of FIR No.31/2015 under Section 385 IPC registered at PS Jama Masjid on the complaint of respondent No.2 on the ground that parties have settled the matter.
The above noted FIR was registered pursuant to the directions passed under Sections 156(3) Cr.P.C. by the learned Metropolitan Magistrate. The allegations of the complainant in the FIR were that he used to squat at Meena Bazar on every Sunday Market and used to sell readymade garments. It is alleged that on 28th September, 2014, the petitioner came to his squatting stall, introduced himself as an advocate and demanded ₹600/- from respondent No.2/complainant for permitting him to squat at the service road of Meena Bazar. When the complainant refused to give money to him, he
forcibly restrained him and did not allow to take his bundle of garments and kept the same with himself. He also misbehaved, abused and threatened the complainant.
Considering the nature of allegations and the fact that the petitioner who is present in Court admits that he is not an advocate but works as clerk of an advocate acted as an imposter and tried to extort money from respondent No.2, this Court finds no ground to quash the above noted FIR and the proceedings pursuant thereto on the ground that the parties have settled the matter.
Petition is dismissed.
