% 05.09.2017 Perusal of file shows that the present matter came up for the first time on 31.08.2016 but nobody appeared for the appellants. In the interest of justice, no adverse orders were passed and the matter was adjourned to 26.09.2016.

On 26.09.2016, the matter was adjourned to 10.11.2016.

On 10.11.2016, operational stay of the impugned judgment and decree was granted subject to deposit of entire decretal amount with interest.

It was made clear that in the event the appellant did not make compliance of the order within the stipulated time, then the order shall stand automatically vacated. The matter was adjourned to 06.03.2017.

Neither the amount was deposited nor the process fee was filed. Thereafter the matter came up before the Registrar on 09.01.2017 but nobody appeared on behalf of the appellants.

On 20.02.2017, the matter was adjourned to 21.04.2017.

On 06.03.2017, the stay order was confirmed and thereafter nobody appeared on behalf of the appellants on 21.04.2017,

20.07.2017 and 21.08.2017. Even today nobody appeared on behalf of the appellants.

This apparently shows that the appellants are not interested to prosecute the present appeal.

The present appeal is accordingly dismissed for non-prosecution.
