O R D E R
% 24.08.2016 We have heard the learned counsel for the parties. The only issue is with regard to the direction given to the appellant/defendant no.1 by the learned single Judge for providing Rs 50,000/- per month by way of maintenance to the plaintiff No.1. Without going into the merits of the matter, the learned counsel for the parties submitted as under:- (1)The learned counsel for defendant No.1 (appellant) suggests that instead of it being a direction of the Court, the defendant no. 1 (appellant who is also present in court) volunteers to pay Rs 25,000/- per month from this month onwards to the plaintiff No.1 in order to maintain her dignity. (2)The learned counsel appearing on behalf of the
respondents/plaintiffs and particularly plaintiff Nos.2 and 3 also volunteer to make a payment of Rs 25,000/- jointly each month towards maintenance of their mother (plaintiff No.1). The above agreed arrangement would ensure that the plaintiff No.1 receives a sum of Rs 50,000/- each month by way of maintenance.
The amount of Rs 3.5 lakhs deposited in Court shall be subject to any orders that the single Judge may pass. The above arrangement supersedes the order which is impugned herein.
The appeal is disposed of.
