O R D E R

% 08.01.2018 After some hearing, the learned counsel for the respondent fairly concedes that the copy of the plan of the building for construction over the plot bearing no.P-62, Chittranjan Park, New Delhi as sanctioned by the Municipal Authority would be produced before the trial court on oath. This concession in fact relates to the application under Order XI Rule 14 of the Code of Civil Procedure, 1908 for discovery of the said document which were dismissed by the learned trial court by order dated 27.02.2016 which is challenged by the petition at hand.

In this view, the petition stands allowed. The document shall be discovered on oath before the trial court on the next fixed before it as undertaken.

The petition and the pending application are disposed of with these observations.
