The matter was listed for September 13, 2016 which was declared a holiday and therefore is being taken up today. 2.

Heard learned counsel for the parties.

I have perused the complaint lodged by the petitioner and I am constrained to hold that the allegations of entrustment of stridhan are against the mother-in-law.

The grievance of the petitioner that the learned Metropolitan Magistrate ought to have directed FIR to be registered is without any substance for the reason no police investigation is warranted. The petitioner would have to establish by leading evidence as to what was her stridhan and to whom it was entrusted. I note that in the matrimonial proceedings the in-laws of the petitioner offered to return such stridhan which they accepted and was left behind in the matrimonial house when the

petitioner left. Petitioner refused to take it back on the plea that it was not complete.

I concur with the view taken by the learned Court of Sessions that instant case does not warrant any FIR to be registered. 5.

I concur with the view taken by the learned Metropolitan Magistrate dismissing application filed by the petitioner under Section 156(3) Cr.P.C. 6.

The petition is dismissed.
