I.A.No. 8291/2016 filed by plaintiff seeking transfer of the matter to the District Courts Defendant has been duly served through counsel. None is present for the defendant.

As per the application, advance payments were made through the bankers at Barakhamba Road and as such jurisdiction lies with New Delhi District. No such averment in this respect has been made in the plaint, which alone is to be seen to ascertain the territorial jurisdiction.

The amended memo of parties shows that defendant is at Canada and whereas out of three addresses given of the plaintiff, one is at Paharganj, New Delhi.

In view of notification no. 27187/DHC/Orgl. Dated 24.11.2015, the present matter stands transferred.

Parties are directed to appear before the Court of Ld. District & Sessions Judge (Central District), Tis Hazari Courts, Delhi on 20th September, 2016.
