1. Status report dated 12th July 2018 has been filed by Inspector Kuldeep Singh, the SHO of PS Govindpuri in which it is stated that the Petitioner married his wife in the year 2011, at which time she converted to Hinduism from Islam and changed her name to „Geeta Devi‟, and that they have a son.

2. It has emerged that the Petitioner‟s wife has chosen to remain in her parental home in Jharkhand after she along with the Petitioner and their son visited there on 28th May 2018. The Petitioner states that his wife insisted on the Petitioner converting to Islam and staying there. The Petitioner lodged a complaint before the police in Jharkhand consequent to which his wife, father-in-law, and son were called before the concerned SSP in Jharkhand in whose presence, the Petitioner‟s wife gave a statement that she W.P.(C) No.1930/2018

does not wish to reside with the Petitioner and that if he wishes to have custody of their child, he should seek approach the appropriate Court.

3. As far as the present complaint of the Petitioner is concerned, SI Sunil Kumar attached to PS Govindpuri contacted the Petitioner‟s wife on her mobile phone. She informed SI Sunil Kumar that she is living with her son Gaurav Mehra at her father‟s house out of her own will and that "she does not want to live with her husband and now she will also complain about taking maintenance against her husband before the concerned family court in Jharkhand".

4. This Court is of the view that the Petitioner should explore other remedies as regards the custody of his child in accordance with the law. No further directions are called for.

5. The petition is disposed of.
