No.5307/2016 (for revival of petition), by petitioner In view of the order dated 20th July, 2015, the petitioner filed the application under Order IX Rule 13 CPC before the Arbitral Tribunal on 31st October, 2015, i.e. after the expiry of more than three months. Learned counsel for the petitioner states that the said application is still pending and is not being decided. Therefore, the present application has been filed by the petitioner to revive the abovementioned petition. The said prayer cannot be allowed. Let the application filed in view of the order dated 20th July, 2015 be considered by the Arbitrator. Copy of this order be sent to the learned Arbitrator, with a request to dispose of the application under Order IX Rule 13 CPC filed by the petitioner as soon as possible. The application is disposed of.
