% 30.11.2016 Crl.M.A. 18731/2016 By this application the petitioner who is present in person seeks leave to withdraw the petition i.e. Crl.M.C. 2303/2016. The petitioner mislead this Court by stating that the FIR was registered in the year 2013 whereas it was registered in the year 2015 and there was delay in trial.
Application seeking withdrawal of the petition is dismissed. CRL.M.C. 2303/2016 By this petition the petitioner has sought directions to the learned Trial Court to conclude the trial because of the delay in the trial. At the time of arguments learned counsel for the petitioner represented that the FIR was registered in the year 2013 and thus on the said CRL.M.C. 2303/2016
representation this Court issued notice to the State and also directed the learned Trial Court to submit a report. A report has been received which clarifies that the FIR was registered in the year 2015 and that charge was framed on 4th March, 2016 where after as many as 3 witnesses were examined till 4th October, 2016. Learned APP for the State submits that 5 witnesses have been examined.
Petition is dismissed.
