W.P.(C) 5327/2016 Petitioner is aggrieved by the fact that his application seeking allotment of alternate plot was rejected vide letter dated 19.5.2015 in spite of the fact that all the requisite documents have been furnished by him. He has drawn attention of this Court to the communication dated 21.5.2013 sent by the respondent to the petitioner followed by another communication dated 12.01.2015.

In this communication khasra girdawari of the acquired land and the latest ID prove including Adhar Card were sought for from

the petitioner.

Learned counsel for the petitioner submits that there was a delay of about 14 days in supplying these documents; the order has been passed on 19.5.2015 rejecting his application although these documents have been furnished by him on 16.02.2015 but they were not considered by the competent Authority. The communication dated 16.02.2015 submitting khasra girdawari and the photocopy of the Adhar Card to the Department having endorsement of the Land and Building Department is a document at page 31 annexure P7. Copy of the said documents is already with the learned counsel for the respondents.

In view of the aforenoted averments, which are made out and since there is only a delay of 14 days in submitting the last two documents, the respondents shall consider the case of the petitioner afresh for allotment of alternate plot. It is made clear that nothing is observed herein which will influence the respondents in taking decision in accordance with law. The case of the petitioner be considered within an outer span of six months from the receipt of the order.

Petition disposed of in the above terms.
