O R D E R

% 01.06.2016 (1) This is a petition under Section 482 Cr.P.C. for quashing of FIR No.0230/2016 under Sections 323/341/354/506/34 IPC registered at PS Patel Nagar. It is stated that the matter has been settled amicably before the Mediation Centre, Delhi High Court, and the petitioner No.1 and Respondent No.2 are living together happily in the matrimonial home.

(2) Respondent No.2/ Complainant is present before the Court with CRL.M.C. 2198/2016

her counsel and is identified by the Investigating Officer. I have enquired from her whether the matter has been settled with the petitioners amicably without fear and pressure. She has stated that the matter has been settled without any fear or pressure and she is living in the matrimonial home.

(3) The petition is supported by the affidavits of the parties. Mediation Report dated 18.05.2016 is on record. Pursuant to the settlement, an FDR in the sum of `5,00,000/- in the name of the complainant has been handed over to the complainant. (copy kept). (4) Since the matter has been settled between the parties and the complainant is residing with petitioner No.1 in the matrimonial home, no useful purpose will be served to continue with the proceedings under Section 323/341/354/506/34 IPC. In the interest of justice and to enable the parties to maintain their matrimonial relations, FIR No.0230/2016 under Sections 323/341/354/506/34 IPC registered at PS Patel Nagar and all the proceedings arising therefrom are quashed. (5) The petitioners are, however, burdened with cost of `20,000/- to be deposited with Prime Minister National Relief Fund within two weeks. The Registry shall ensure the compliance of the order. (6) The petition is disposed of accordingly.
