% 28.02.2017 Learned counsel for the defendants has drawn the attention of this court to the order dated 19.10.2012 passed by the Supreme Court in SLP (Civil) No. 32998/2012 whereby the Supreme Court had directed that following disclaimer should also be included in the audio version and the same should be added before the song in question is played. "Use of the names of the song are merely as example. No injury or disrespect is intended to any particular person or brand."
The learned counsel for the defendants submits that the said order has been and is being complied with.
In view of the above statement the learned counsel for the plaintiff CS (OS) 3010/2012
seeks to withdraw the present suit.
The suit is dismissed as withdrawn.
