Petitioner impugns order dated 10.09.2015 whereby appeal filed against order on conviction dated 20.06.2015 and order on sentence dated 20.07.2015 was dismissed.

The petitioner was convicted of offence 392/34 IPC and sentenced to undergo rigorous imprisonment for a period of three years with fine of Rs 3,000/- each and incase of default of payment of fine, further to undergo simple imprisonment of six months. 3.

The allegations against the petitioner are that on 22.08.2007 at about 9:30 p.m. at Tikona Park, Jantar Mantar, he robbed the mobile phone of the complainant.

On perusal of the evidence the Trial Court was satisfied that the prosecution had proved the case beyond reasonable doubt that the CRL.REV.P. 451/2016

petitioner had committed the robbery and snatched the mobile phone from the complainant and it was also recovered from the possession of the accused immediately after the incident. 5.

On perusal of the record, I find no infirmity in the view taken by the Trial Court and the Appellate Court in convicting the petitioner of offence punishable under section 392/34 IPC. 6.

Nominal Roll of the petitioner indicates that the petitioner has already undergone sentence and stands released on 15.02.2018 in the subject FIR.

The petition is accordingly dismissed.
