Learned counsel for the petitioner states that pursuant to the order dated May 02, 2016 passed by learned DRT-I the Recovery Officer has dismissed the objections filed by the petitioner concerning attachment and sale of the flat in question.

Learned counsel for the petitioner concedes that against said order remedy of appeal before DRAT is available. Learned counsel seeks leave to withdraw the writ petition to enable the petitioner to lay a challenge to the order passed by the Recovery Officer dismissing the objections filed. 3.

The writ petition is dismissed as not pressed. W.P.(C) 6209/2016

Needless to state, the appeal filed by the petitioner against the order passed by the Recovery Officer dismissing the objections filed by the petitioner shall be decided by DRAT as per law. 5.

No costs.
