% 03.10.2018 Notice could not be issued as the process fee was again not filed. On 10.08.2018, this Court had passed the following order: "Counsel for the appellant submits that parties had appeared before a mediator in the year 2013 and had almost resolved their disputes. However, thereafter the respondent has stopped cooperating. He submits that a notice be issued on the limited prayer only as to whether the parties can amicably resolve the matter. He submits that he is willing to pay a sum of Rs.2,000/- to the respondent for her travelling to the Court on the next date of hearing in Court. Let a notice be issued to the limited prayer as to whether the parties can amicably resolve the matter amicably. The notice would communicate that the respondent would be paid a sum of Rs.2,000/- on the next date of hearing when she would attend the Court. The appeal is not pressed.
List on 30.08.2018, when the parties are directed to remain present in Court."
On 10.08.2018, the matter was adjourned for 30.08.2018 and on 30.08.2018 for today. On both the occasions, the process fee had not been filed.
In view of the fact that the notice was issued on the limited prayer only as to whether the parties can amicably resolve the matter and since despite the
matter having been adjourned on two occasions, process fee had not been filed, no further orders are required to be passed in the matter. Accordingly, the appeal and C.M.32043/2018 stand disposed of. G.S.SISTANI, J SANGITA DHINGRA SEHGAL, J OCTOBER 03, 2018 rb MAT.APP.(F.C.) 192/2018
