% 06.09.2017 Present case has been listed by the Joint Registrar before the Court on account of non-prosecution.

A perusal of the order sheets reveal that neither the receipt towards costs imposed vide order dated 31st January, 2017 has been deposited nor anyone has appeared for the plaintiff on 31st January, 2017, 19th May, 2017 and 09th August, 2017. Even the plaintiff's witnesses had not appeared on the said dates though the matter had been fixed for recording of their evidence. Consequently, the present suit is dismissed in default and on account of non-prosecution. The ad interim injunction order dated 05th March, 2013 is vacated.
