% 29.07.2016 The petitioner is aggrieved by the fact that inspite of his having filed an appeal against the alleged illegal order passed by the SDM on 21.04.2016 (appellate body), the Deputy Commissioner has not taken up his appeal for hearing. It is pointed out that the earlier dates fixed before the Deputy Commissioner dated 09.06.2016 on which date the matter stood adjournment on 27.07.2016. On both the aforenoted dates, the Deputy Commissioner did not hold the Court and the next date now fixed before him is 16.08.2016. The apprehension of the petitioner is that the matter may not be taken up on that date also. Learned counsel for the respondent accepts notice. The urgency of the matter has been informed to the learned counsel for the respondent. The urgency appears to be all the more for the reason that the petitioner has to come to this Court to obtain a status quo and which is enuring in his favour in terms of a direction given by this
Court.
In this background, respondent No. 1/Deputy Commissioner is directed to dispose of the appeal of the petitioner positively on 16.08.2016 and if for some unforeseen exigencies he cannot dispose of the appeal on 16.08.2016, he shall deal with it on the next date. Till that date, the interim order enuring in favour of the petitioner will continue.
Petition disposed of.
