% 08.07.2016 Since 7th July, 2016 was declared a holiday, the matter has been taken up today.
By this petition, the petitioner seeks anticipatory bail in case FIR No. 362/2016 under Sections 354/354B/451/506/509/34 IPC registered at PS Shahbad Diary, Delhi.
Learned APP submits that the allegations of the complainant in the FIR against the petitioner and his friends are of teasing while moving on the street and giving bad signals. It is further alleged that on 17th April, 2016 at around 12.00 PM the petitioner along with two three friends came to the house of the complainant and misbehaved with her. Thus she sought action against the petitioner and the co-accused for outraging her modesty and threatening. Allegations being serious no anticipatory bail be granted to the petitioner.

As per the documents placed on record by the petitioner, it is alleged that Mohd. Asif s/o Mohd. Ilyas, husband of the petitioner's sister is having extra marital relation with the complainant in the present FIR. It is the case of the petitioner that on 16th April, 2016 his sister was badly assaulted by Asif when her MLC was prepared and a complaint was lodged at 100 number. As a counter blast to the said MLC and complaint, the complainant lodged the present FIR.
Be that as it may, the petitioner has already joined the investigation. No investigation has been carried out by the Investigating Officer in respect to the complaint lodged by the sister of the petitioner. Considering the facts and circumstances, I deem it fit to grant anticipatory bail to the petitioner. It is therefore, directed that in the event of arrest, petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned. The petitioner will not leave Delhi without prior permission of the learned Trial Court concerned. This condition may be varied by the learned Trial Court if deemed fit. Petition is disposed of.
