There is no appearance on behalf of the appellant. Same has been the position since 11.12.2018 onwards even though the matter was listed on as many as seven occasions, including today. 2.

It seems that the appellant is no longer interested in pursuing with the present matter.

As such, the order dated 29.07.2008, whereby the execution of the impugned judgment and decree was stayed, stands vacated. 4.

Accordingly, the present appeal is dismissed for non-prosecution and for non-appearance.
