O R D E R

% 27.07.2017 The learned counsel for the parties submit that the matter has been settled.

The learned counsel for the petitioner submits that he will file an affidavit of undertaking of the petitioner to vacate the tenanted property by 30.06.2019. He will also undertake to pay user charges @ Rs.7,500/- per month w.e.f. 01.07.2017. The user charges shall be paid by 7th day of each English Calendar month. He will also undertake not to part with possession of the property to any third party or cause any wilful damages to the property. He will also undertake to pay electricity and water charges payable.

The learned counsel for the respondent, on instructions from the respondent who appears in person in court, submits that in case an affidavit of undertaking is filed by the petitioner within two weeks from today, the

respondent shall not execute the eviction order before 30.06.2019. The petitioner may file an affidavit of undertaking within two weeks from today as indicated above. The petitioner shall remain bound by the terms and conditions of the undertaking.

The learned counsel for the respondent shall file and give a copy of the particulars of the bank account of the respondent to enable the petitioner to deposit the monthly user charges in terms of the undertaking of the petitioner.

Petition stands disposed of. All the pending applications also stand disposed of.

A copy of this order be given dasti under the signature of the court master.
