% 18.07.2016 Petitioner is aggrieved by the fact that in spite of the fact that unauthorised constructions having been taken place in the roof of the second floor of the disputed Flat i.e. Flat bearing no.F-13E respondents had taken no action.
As per the averments made in the petition, respondent no.4 has done this unauthorised construction.
Respondent no.1 on advance notice has put in appearance. Her submission is that this is an interpersonal dispute between the petitioner and respondent no.4. The property has, however, been inspected one week ago and no fresh construction has been noted. If any deviation is noted in the property action will be taken in accordance with law.
In view of this undertaking having been given by the learned counsel for respondent no.1 no further order is called for.
Respondent no.1 will take action within an outer limit of 8 weeks from today and intimate the same to the petitioner. No further orders are called for.
Petition disposed of.
