% 01.04.2016 Despite second call, no one has appeared for the petitioner. In the morning, request for passover was made.

Counsel for the respondent has relied upon decisions of the Supreme Court in Mathew P. Thomas versus Kerala State Civil Supply Corporation Limited, (2003) 3 SCC 263, Abhijit Gupta versus S.N.B. National Centre, Basic Sciences and Others, (2006) 4 SCC 469 and State of West Bengal and Others versus Tapas Roy, (2006) 6 SCC 453 on the question that in this case the termination of the petitioner during the probation period was not stigmatic. He has also drawn our attention to the establishment order dated 7th January, 2011.

Learned counsel for the respondent has submitted that in the present case the writ petition was dismissed for default on 12th September, 2014 and thereafter it was restored and listed for hearing. He submits that the petitioner probably is marking time and deliberately delaying the writ petition.

Dismissed in default.
