% 22.09.2016 Petitioners No.1 and 3 have given a statement in court today undertaking to vacate the premises in question i.e. Shop at ground floor of the property bearing No. 11E/28, East Patel Nagar, New Delhi on or before 30.06.2018 and to hand over vacant physical possession of the property to the respondent. Other terms and conditions have also been stated in the statement. The statement is taken on record. The said petitioners shall remain bound by the said statement.

Learned counsel for the petitioners submits that the other copetitioners, namely, Smt. Ramesh Gupta, Smt. Sudha Gupta, Sh. Gaurav Gupta, Ms. Puja Gupta and Ms.Manju Gupta shall also remain bound by the statement made today by petitioners No.1 and 3. She submits that as a

precaution, the affidavits of the other petitioners giving an undertaking to vacate the premises in question on or before 30.06.2018 as per the statement made in court by Smt. Meera Gupta, petitioner No.1 and Sh. Anup Gupta, petitioner No.3 shall also be filed within two weeks from today. In view of the above, the learned senior counsel appearing for the respondent submits that the respondent shall not execute the eviction order till 30.06.2018.

Gupta r/o 11E/28, East Patel Nagar, New Delhi on SA I undertake to this court to vacate the property in question i.e. Shop at ground floor of the property bearing No. 11E/28, East Patel Nagar, New Delhi and hand over vacant physical possession of the property to the respondent on or before 30.06.2018. I also undertake to pay the up to date agreed rent, electricity and water charges payable for the period of possession of the property. I undertake not to cause any wilful damage to the property or induct any third party into the property. RO&AC JAYANT NATH, J.
