% 07.02.2017 Despite a pass over none is present for the petitioners. Consequently, this Court has no other option but to proceed ahead with the matters. It is pertinent to mention that present contempt petitions have been filed alleging wilful disobedience of the order dated 29'*' May, 2015 passed in W.P.(C) 5786/2015 whereby respondent-M/s. Sam International School was restrained from terminating the services of the petitioners.
M In the present contempt petitions, it has been averred that despite the aforesaid order, the services of the petitioner have been terminated. However, this Court finds that the W.P.(C) 5786/2015 has been dismissed by a Coordinate Bench of this Court vide judgment and the order dated 30^^ January, 2017 holding that the petitioners were never the employees of the respondent-School.
Consequently, the question of terminating the petitioners either before or during or after the interim order dated 29^^ May, 2015 does not arise.
Accordingly, the present contempt petitions and pending applications are dismissed on merits as well as on account of non-prosecution. MANMOHAN, J FEBRUARY 07, 2017 m
