This hearing has been conducted through hybrid mode. 2.

The present appeal has been filed by the Appellant - Pawan under Section 374 of the Cr.P.C., 1973 against the judgment and order on sentence dated 02nd March, 2007 and 08th March, 2007, respectively, passed by the learned Additional Sessions Judge, Karkardooma Courts, Delhi, in Session Case bearing No. 83/2006 arising out of FIR No. 342/2004 registered under Sections 376/506 IPC at PS-Farsh Bazar. 3.

The Appellant was convicted under Section 376 and 506 IPC. 4.

It is submitted that the Appellant was released from the jail on 9th August, 2010 after completing the sentence awarded to him. 5.

The Appellant was unable to contact via Video Conference (VC), but has established contact through the IO's WhatsApp (VC). He states that he does not wish to press this appeal on the ground that it has become infructuous, as he has already served his sentence. The Appellant has been identified by SI Neelam, PS - Farsh Bazar. After questioning the Appellant, this Court is satisfied that he is making the statement after knowing the consequences of the same, as he has been made aware of the consequences of his statement. 7.

The Trial Court Record and Nominal Roll of the Appellant perused.

Keeping in view the statement of the Appellant, which is taken on record, and the fact that the Appellant has already served the sentence awarded by the Trial Court, the present appeal is disposed of as not pressed. Pending application(s), if any, also stand disposed of. 9.

A copy of this order be sent to the concerned Jail Superintendent as well as to the concerned Trial Court.
