O R D E R

% 09.03.2024 In the pre-sitting Lok Adalat held on 23.01.2024, the parties have arrived at the following settlement:

"Mr. Ankit Malhotra along with Ms. Shikha Malhotra w/o of Mr. Ankit Malhotra (Owner) appeared physically in person and submitted copy of NOC dated 27.12.2023 of Sh. Anil Sethi LR of the original petitioner and the perusal of said NOC shows that LR of the petitioner unequivocally wants to withdraw the petition.

The perusal of the records shows that even earlier in the order dated 06.12.2023, both the parties had agreed for withdrawal of the petition as a result of the settlement, but before the Hon'ble High Court in the National Lok Adalat held on 10.12.2023, counsel for the petitioner stated that he is not inclined to settle the matter. Thus by way of abundant caution, today the LR of the petitioner Mr. Anil Sethi was asked to join VC Link, he joined but due to technical problem, he was not audible. stated that he can make a video call through WhatsApp on his phone to Mr. Anil Sethi. It was permitted. The identity of Mr. Anil Sethi was checked as per Aadhaar Card annexed along with NOC. Mr. Ankit Malhotra submitted that he is the same Mr. Anil Sethi. Mr. Anil Sethi categorically stated in the WhatsApp Video Call that the matter has been settled and he wished to withdraw the petition and he has also stated that he cannot physically come. The statement of the LR of the petitioner Mr. Anil Sethi is separately recorded. Mr. Ankit Malhotra has given the email id of Mr. Anil Sethi LR of the petitioner i.e.

archnagoods@gmail.com and kls_industries@yahoo.co.in (Email of Mr. Ankit Malhotra). Statement of LR of the petitioner Mr. Anil Sethi be sent through email and direction to sign the statement after carefully reading the statement and the same be sent back to the email. It is ensured that the statement originally signed by Mr. Anil Sethi be provided to so as to place the same on the record. LR of the petitioner has been informed that he can appear physically or through VC, Notice be sent to LR of the petitioner. Notice be also be issued to the counsel of Petitioner for appearance before the National Lok Adalat on 09.03.2024."

Today, before the National Lok Adalat, Mr. Mangal Sain Sethi, appeared in person along with Mr. Ankit Malhotra and Ms. Shikha Malhotra and they have confirmed the settlement arrived in pre-sitting held Lok Adalat held on 23.01.2024.

In view of the settlement arrived between the parties and also in view of the statement of authorised officer of the respondent company i.e. NDPL that the subject matter of the writ petition has been settled in permanent Lok Adalat held of 05.11.2023, nothing more shall be payable irrespective of the subject matter of the writ petition, the writ The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
