% 21.10.2016 C.M.No. 38975/2016 (u/S 151 CPC) By this application, applicant-appellant seeks release of the deposited amount in terms of order of 2nd May, 2015, vide which the appeal was disposed of.

Issuance of notice of this application to respondents is dispensed with for the reason that vide order of 2nd May, 2013 it was directed that balance of the deposited amount be kept in fixed deposit receipt for three years.

Since the appeal stands already allowed, therefore, it is directed that the pre-deposited amount lying deposited in fixed deposit receipt along with interest accrued thereupon be released to applicant-appellant forthwith as per rules.

The application is disposed of.
