% 16.08.2016 On the complaint of respondent no. 2, present FIR no. 140/2016 under Sections 279/337 IPC was registered at Police Station Vasant Vihar. Respondent no. 2 has alleged in the FIR that petitioner, while driving his car in rash and negligent manner, hit him resulting injuries to him. Occupants of the car got down and put him in the car and left him in front of a hospital at Sarojini Nagar.
Thereafter, he stopped a TSR and went to Safdarjang Hospital.
Petitioner has been identified by the respondent no. 2 in TIP.
Respondent no. 2 sustained simple injuries in the accident. Respondent no. 2 and petitioner have compromised the matter vide Compromise Deed dated 30th May, 2016. Petitioner has compensated the respondent no. 2 by paying `50,000/- to him.
Respondent no. 2 is present in Court and has been identified by SI Rakesh Yadav, P.S. Vasant Vihar. Investigations are still going on. Respondent no. 2 admits having received `50,000/- and submits that he has no objection in case FIR is quashed. Keeping in mind the fact that parties have settled their disputes amicably, inasmuch as petitioner has compensated respondent no. 2 during the investigation itself, in the interest of justice, FIR no. 140/2016 under Sections 279/337 IPC registered at Police Station Vasant Vihar and the consequent proceedings emanating therefrom are quashed.
