versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR ..... Respondents Through Mr.Anil Soni, Advocate for R- 1 & 2.
CORAM:
HON'BLE MR. JUSTICE MANMOHAN
O R D E R
% 03.06.2016 Present writ petition has been filed seeking a direction to the respondents to process and decide the petitioners' application for grant of final recognition for remaining one unit of D.El.Ed. course for academic session 2016-2017.
It has been averred in the petition that on 30th June, 2015 petitioner applied for recognition of D.El.Ed. course for two units, i.e., 100 intakes for academic session 2016-17. It is the petitioners' case that though the entire processing of application was done by respondent no 2 -ERC for two units, i.e., 100 intakes, yet the ERC in its meeting held on 29th-30th April, 2016 and 1st-2nd May, 2016 decided to grant permission for only one unit, i.e., 50 intake for academic session 20162017.
Learned counsel for petitioners contends that respondent no.2 has neither rejected nor allowed the application of the petitioners for the second unit. He states that rejection, if any, has to be preceded by a show cause notice which has not been issued so far. He further states that no deficiency has been pointed out by respondent no.2 with regard to the second unit. Keeping in view the aforesaid, the present writ petition is directed to be treated as a representation by respondent no.2 and to be decided by way of a reasoned order within two months in accordance with the law. With the aforesaid directions, present writ petitions and the applications stand disposed of.
Order dasti.
