The learned counsel for the petitioner seeks to delete the names of respondent nos. 2 and 3 from the array of parties and requests that the present application be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act') to be considered by the Arbitral Tribunal.

I see no objections to the aforesaid course; accordingly, it is directed that the present application be treated as an application under Section 17 of the Act by the Arbitrator. The petitioner would place a photocopy of the record filed in this Court in this petition before the Arbitrator within a period of one week from today.

The Arbitrator is requested to dispose of this application (as application under Section 17 of the Act) as expeditiously as possible and preferably within a period of three weeks from today. 4.

Respondent no.1 will be continued to be bound by the statement made by the counsel on 02.06.2016 for three weeks from today and will be subject to any order that may be passed by the Arbitral Tribunal. 5.
