O R D E R

Appellant Insurance Company has filed an appeal for reduction of the award dated 06.08.2013 passed by the Learned MACT, awarding a compensation of Rs. 33,91,355/- along with interest @ 9% p.a. from the date of filing of claim petition.

Learned Counsel for the appellant on instruction submits that entire awarded amount along with accrued interest has been deposited before the concerned Tribunal and we find that direction was issued to release 60% of the awarded amount in favour of R-1. 3.

Learned Counsel for the appellant on instructions has agreed to withdraw the appeal and submitted that there is no cross appeal. 4.

Learned Counsel for the respondent No. 1 has submitted that the respondent has changed the bank account and the details of the bank account are reads as under:

(i) Bank Name- Canara Bank, Branch- Bahadurgarh Railway Road Bahadurgarh, Haryana - 124507.

of the original blank cheque is taken on record). 5.

In view of the settlement, the balance deposited amount of 40 % of the award along with the accrued interest be released to the respondent No. 1 in the account mentioned above, subject to compliance of all the requisite formalities.

Learned Counsel for Insurance Company on instruction have submitted that the name of the appellant i.e. Reliance General Insurance Company has been changed to Indusind General Insurance Company Limited and the Learned counsel for the insurance company has further submitted that NOC has been issued by IRDAI and new certificate of incorporation issued by ROC in favour of IGICL. It is submitted that from now onwards, the name of the appellant shall be read as Indusind General Insurance Company Limited (formerly -Reliance General Insurance Company).

On filing of the copy of certificate of incorporation issued by ROC in favour of IGICL, in the Registry, the statutory amount along with the interest, if any, be refunded to Indusind General Insurance Company Limited on compliance of all the requisite formalities. 8.

Accordingly, the present appeal along with the pending applications, if any, is disposed of with directions in term of the settlement.
